Preparing or responding to a Letter of Claim
Litigation should generally be a last resort. In the first instance, the parties are required to follow the relevant Pre-Action Protocol. This means that a claimant should set out the factual and legal basis of their claim, and what they are seeking, in a Letter of Claim. A defendant is then afforded time to set out their position in a Letter of Response. It is crucial that the parties seek legal advice before preparing a Letter of Claim or Letter of Response. In all but the most straightforward cases, these letters will be drafted by solicitors. Following the exchange of initial letters, the parties should seek to resolve the dispute. Where a resolution is not possible, a claimant must decide whether to pursue the matter in court by issuing a claim.

The majority of our work is conducted in the Business and Property Courts, (typically the Royal Courts of Justice/Rolls Building/Central London County Court), but we also assist with high value claims being tried at county courts venue across England and Wales.
