Vishalee specialises in general civil/commercial litigation, including civil fraud, professional negligence, breach of contract, property litigation and insolvency.

Vishalee has extensive experience in representing clients at all stages of litigation and is empathetic to her clients’ circumstances whilst also adopting a robust approach with her opponents in order to achieve her clients’ objectives.

Vishalee’s recent work highlights include:-

Commercial litigation

  • Secured settlement on behalf of a client subject to three connected claims relating to the possession of luxury vehicles, alleged breach of trust and breach of contract.
  • Secured damages for clients who suffered loss as a result of negligence on the part of solicitors instructed in the purchase of their home.
  • Successfully obtained summary judgment in relation to a claim brought against a corporate lender for alleged breach of contract and negligence.
  • Secured settlement in relation to an alleged breach of a loan agreement and successfully opposed a claim for default interest and charges on the basis that they were an unlawful penalty.

Civil Fraud

  • Acted on behalf of one of 16 defendants subject to a multi-billion pound claim relating to alleged breach of fiduciary duties as Bitcoin developers which was ultimately discontinued by the claimant.
  • Advising numerous clients in relation to prospective recovery of digital assets that have been stolen or withheld improperly.

Insolvency and Debt Recovery

  • Securing substantial settlements on behalf of a large corporate lender.
  • Successfully obtaining numerous winding up and bankruptcy orders against companies and individuals on behalf of a corporate lender client.
  • Successfully resisting bankruptcy proceedings being issued against a client on the basis of recoverability issues and a reasonable payment plan being in place.
  • Securing annulment of a bankruptcy order on behalf of a client who had not received the petition and who settled their debts promptly following the making of the bankruptcy order.

Property Litigation

  • Recovering service charge and ground rent arrears on behalf of a freeholder with a portfolio of properties.
  • Successfully obtaining forfeiture of long residential leases where the leaseholders have failed to pay significant sums in relation to service charge and ground rent arrears.
  • Obtaining possession of a property on behalf of an overseas client whose tenant was in significant rental arrears and refusing to leave the property.
  • Securing settlement and removal of a historic charge in relation to a dispute over ownership of a commercial property.

Vishalee is dual qualified as a Solicitor in England and Wales (2011) and an Attorney and Counselor-at-Law in New York (2009).

Other work

Prior to joining Brett Wilson, Vishalee was a Senior Solicitor at Howell-Jones LLP, where in Christopher Doyle v PRA Group (UK) Limited [2019] EWCA Civ 12 she successfully led a case to the Court of Appeal in front of the Master of the Rolls and two Lord Justices on behalf of PRA Group, and obtained a landmark Judgment regarding when time starts running for limitation purposes in cases concerning the Consumer Credit Act 1974.
